وَتَصِحُّ هِبَةُ كُلِّ دَينٍ وَلَوْ سَلَمًا لِمَدِينٍ فَقَطْ لَا لِغَيرِهِ إلَّا لِضَامِنِهِ.

مطالب أولي النهىal-Ruhaybani

(لَا) يَصِحُّ هِبَةُ الدَّيْنِ (لِغَيْرِهِ) ؛ أَيْ: غَيْرِ الْمَدِينُ، (إلَّا لِضَامِنِهِ) بِهِ، فَيَصِحُّ؛ لِأَنَّهُ فِي مَعْنَى الْإِسْقَاطِ.
