وَلَوْ قَالَ رَبُّ الدَّيْنَ لِغَرِيمِهِ: (تَصَدَّقْ عَنِّي بِكَذَا، وَلَمْ يَقُلْ مِنْ دَيْنِي) أَوْ قَالَ: أَعْطِ فُلَانًا كَذَا، وَلَمْ يَقُلْ مِنْ دَيْنِي؛ ذَلِكَ، (وَكَانَ اقْتِرَاضًا) ، لَا تَصَرُّفًا فِي الدَّيْنِ قَبْلَ قَبْضِهِ؛ كَمَا لَوْ قَالَهُ لِغَيْرِ غَرِيمِهِ،
