(وَكَذَا لَوْ أَقَرَّ) رَبُّ دَيْنٍ (بِهِ) ؛ أَيْ: الدَّيْنِ (لِلْغَيْرِ) فَيَبْرَأُ ضَامِنٌ وَكَفِيلٌ؛ لِأَنَّهُ إنَّمَا ضَمِنَهُ لَهُ، لَا لِلْغَيْرِ.
وَلَا يَبْرَأُ ضَامِنٌ وَكَفِيلٌ، وَلَا يَبْطُلُ رَهْنٌ
