مطالب أولي النهىal-Ruhaybani

(وَإِنْ بَرِئَ مَدْيُونٌ) بِوَفَاءٍ، أَوْ إبْرَاءٍ أَوْ حَوَالَةٍ (بَرِئَ ضَامِنُهُ) ؛ لِأَنَّهُ تَبَعٌ لَهُ وَالضَّمَانُ وَثِيقَةٌ - فَإِذَا بَرِئَ الْأَصِيلُ زَالَتْ الْوَثِيقَةُ؛ كَالرَّهْنِ، (وَلَا عَكْسُ) ؛ أَيْ: لَا يَبْرَأُ مَدِينٌ بِبَرَاءَةِ ضَامِنِهِ؛ لِعَدَمِ تَبَعِيَّتِهِ لَهُ
