لَا إنْ أَخَذَهُ لِذَلِكَ بِلَا مُسَاوَمَةٍ أَوْ قَطعِ ثَمَنٍ.

مطالب أولي النهىal-Ruhaybani

(لَا) ضَمَانَ عَلَى أَخْذِهِ (إنْ أَخَذَهُ لِذَلِكَ) ؛ أَيْ: لِيُرِيَهُ أَهْلَهُ (بِلَا مُسَاوَمَةٍ أَوْ قَطْعِ ثَمَنٍ) ؛ لِأَنَّهُ لَا سَوْمَ فِيهِ؛ فَلَا يَصِحُّ ضَمَانٌ.

وَمَعْنَى ضَمَانِ الْغَصْبِ وَنَحْوِهِ ضَمَانُ انْتِقَاضِهِ وَالْتِزَامُ تَحْصِيلِهِ أَوْ قِيمَتِهِ عِنْدَ تَلَفِهِ؛ فَهُوَ كَعُهْدَةِ الْمَبِيعِ
