(وَيَتَّجِهُ) لَوْ أَجَابَهُ لِمَا سَأَلَهُ وَأُبْرِئَ الْكَفِيلُ، ثُمَّ امْتَنَعَ السَّائِلُ مِنْ الْكَفَالَةِ؛ يَفْسُدُ الْعَقْدُ، (وَتَصِحُّ الْبَرَاءَةُ) ، لَكِنْ نُقِلَ عَنْ الْقَاضِي أَنَّهُ قَالَ: لَا يَبْرَأُ مَكْفُولٌ بِهَذِهِ الْبَرَاءَةِ؛ لِأَنَّ رَبَّ الدَّيْنِ إنَّمَا أَبْرَأَهُ اعْتِمَادًا عَلَى صِدْقِ السَّائِلِ،
