مطالب أولي النهىal-Ruhaybani

(وَشَرْطُ) الْحَوَالَةِ خَمْسَةُ شُرُوطٍ:

أَحَدُهَا (رِضَى مُحِيلٍ) ؛ لِأَنَّ الْحَقَّ عَلَيْهِ فَلَا يَلْزَمُهُ أَدَاؤُهُ مِنْ جُمْلَةِ الدَّيْنِ عَلَى الْمُحَالِ عَلَيْهِ. (وَ) الثَّانِي (عِلْمُ) مَالٍ (مُحَالٍ بِهِ) وَاسْتِقْرَارُهُ فِي ذِمَّةِ الْمُحَالِ (عَلَيْهِ) ؛ لِاعْتِبَارِ التَّسْلِيمِ، وَالْجَهَالَةُ تَمْنَعُ مِنْهُ.
