(وَلِمُسْتَأْجِرٍ وَمُسْتَعِيرٍ الصُّلْحُ عَلَى سَاقِيَةٍ؛ أَيْ: قَنَاةٍ مَحْفُورَةٍ) فِي أَرْضٍ اسْتَأْجَرَهَا أَوْ اسْتَعَارَهَا لِيُجْرِيَ الْغَيْرُ مَاءَهُ فِيهَا؛ لِدَلَالَتِهِ عَلَى رَسْمٍ قَدِيمٍ وَلَكِنْ لَا يَجُوزُ الصُّلْحُ إلَّا (بِقَدْرِ مُدَّةِ [الْإِجَارَةِ] ) فَإِنْ لَمْ تَكُنْ السَّاقِيَّةُ مَحْفُورَةً؛ لَمْ يَجُزْ إحْدَاثُهَا فِيهَا.
