وَإِنْ صَالحَهُ عَلَى سَقيِ أَرْضِهِ مِنْ نَهْرِهِ أَوْ عَينِهِ مُدَّةً وَلَوْ مُعَيَّنَةً لَمْ يَصِحَّ لِعَدَمِ مِلْكِهِ الْمَاءَ،

مطالب أولي النهىal-Ruhaybani

(مِنْ نَهْرِهِ) ؛ أَيْ: عَمْرٍو (أَوْ) مِنْ (عَيْنِهِ) أَوْ بِئْرِهِ الْمُعَيَّنِ (مُدَّةً - وَلَوْ) كَانَتْ مُدَّةُ السَّقْيِ (مُعَيَّنَةً - لَمْ يَصِحَّ) الصُّلْحُ بِعِوَضٍ؛ (لِعَدَمِ مِلْكِهِ الْمَاءَ) ؛ لِأَنَّ مَاءَ الْعَيْنِ لَا يُمْلَكُ بِمِلْكِ الْأَرْضِ، كَمَا تَقَدَّمَ.
