وَفَتحُهُ لِغَيرِ اسْتِطرَاقٍ كَلِضَوْءٍ وَهَوَاءٍ ،

مطالب أولي النهىal-Ruhaybani

(وَيَجُوزُ فَتْحُهُ) ، أَيْ: الْبَابِ فِي ظَهْرِ دَارٍ فِي دَرْبٍ غَيْرِ نَافِذٍ بِلَا إذْنِ أَهْلِهِ (لِغَيْرِ اسْتِطْرَاقٍ كَالضَّوْءِ وَهَوَاءٍ) ؛ لِأَنَّ الْحَقَّ لِأَهْلِهِ فِي الِاسْتِطْرَاقِ؛ وَلَمْ يُزَاحِمْهُمْ فِيهِ، وَلِأَنَّ غَايَتَهُ التَّصَرُّفُ فِي مِلْكِ نَفْسِهِ بِرَفْعِ بَعْضِ حَائِطِهِ.
