مطالب أولي النهىal-Ruhaybani

(وَيَضْمَنُ) مَنْ أَحْدَثَ بِمِلْكِهِ مَا يَضُرُّ بِجَارِهِ (مَا تَلِفَ بِذَلِكَ) بِسَبَبِ الْإِحْدَاثِ؛ لِتَعَدِّيهِ بِهِ، (وَلِجَارِهِ مَنْعُهُ إنْ أَحْدَثَ ذَلِكَ كَابْتِدَاءِ إحْيَائِهِ) ؛ أَيْ: كَمَا لَهُ مَنْعُهُ مِنْ إحْيَاءِ مَا بِجِوَارِهِ؛ لِتَعَلُّقِ مَصَالِحِهِ بِهِ كَمَا لَهُ مَنْعُهُ مِنْ دَقٍّ وَسَقْيٍ يَتَعَدَّى إلَيْهِ،
