وَلَوْ أَذِنَ لِجَارِهِ في الْبِنَاءِ عَلَى حَائِطِهِ، أَوْ وَضْعِ سُتْرَةٍ، أَوْ خَشَبٍ عَلَيهِ حَيثُ لَا يَسْتَحِقُّ وَضْعَهُ جَازَ وَصارَ عَارِيَّةً لَازِمَةً.

(وَلَوْ أَذِنَ جَارٌ لِجَارِهِ فِي الْبِنَاءِ عَلَى حَائِطِهِ، أَوْ فِي وَضْعِ سُتْرَةٍ، أَوْ) فِي وَضْعِ (خَشَبٍ) وَنَحْوِ ذَلِكَ (عَلَيْهِ) ؛ أَيْ: حَائِطِهِ (حَيْثُ لَا يَسْتَحِقُّ وَضْعَهُ) عَلَيْهِ؛ (جَازَ) ؛ لِأَنَّ الْحَقَّ لَهُ، (وَصَارَ) ذَلِكَ (عَارِيَّةً لَازِمَةً) . وَيَأْتِي.
