(وَيَنْفُذُ) التَّصَرُّفُ فِي جَمِيعِ الْمَالِ (مِنْ كُلِّ) وَاحِدٍ مِنْ الشُّرَكَاءِ (بِحُكْمِ الْمِلْكِ فِي نَصِيبِهِ، وَ) بِحُكْمِ (الْوَكَالَةِ فِي نَصِيبِ شَرِيكِهِ) ؛ لِأَنَّهَا مَبْنِيَّةٌ عَلَى الْوَكَالَةِ وَالْأَمَانَةِ
