(وَلَا يُعْتَبَرُ لِمُضَارَبَةٍ قَبْضُ) عَامِلٍ (رَأْسَ مَالٍ) ، فَتَصِحُّ - وَإِنْ كَانَ بِيَدِ رَبِّهِ - لِأَنَّ مَوْرِدَ الْعَقْدِ الْعَمَلُ، (وَلَا الْقَوْلُ) ؛ أَيْ: قَوْلُهُ قَبِلْتُ وَنَحْوُهُ (بِمَا يُؤَدِّي مَعْنَاهَا، فَتَكْفِي مُبَاشَرَتُهُ) - أَيْ: الْعَمَلِ قَبُولًا.
