وَلَا يَخْلِطُ رَأْسَ مَالٍ قَبَضَهُ مِنْ وَاحِدٍ فِي وَقتَينِ بِلَا إذْن لأنهُمَا عَقدَانِ، فَلَا يُجْبَرُ أَحَدُهُمَا مِنْ الآخَرِ

(وَلَا يَخْلِطُ) عَامِلٌ (رَأْسَ مَالٍ قَبَضَهُ مِنْ) مَالِكٍ (وَاحِدٍ فِي وَقْتَيْنِ بِلَا إذْنٍ) نَصًّا؛ (لِأَنَّهُمَا) - أَيْ: الْمَالَيْنِ - (عَقْدَانِ، فَلَا يُجْبَرُ) خُسْرَانُ (أَحَدِهِمَا مِنْ) رِبْحِ الْمَالِ الْآخَرِ؛ كَمَا لَوْ نَهَاهُ عَنْ خَلْطِهِمَا.
