(وَشُرِطَ) لِصِحَّةِ مُسَاقَاةٍ وَمُنَاصَبَةٍ وَمُزَارَعَةٍ (كَوْنُ عَاقِدِ كُلٍّ) مِنْهَا (نَافِذَ التَّصَرُّفِ) بِأَنْ يَكُونَ حُرًّا بَالِغًا رَشِيدًا؛ لِأَنَّهَا عُقُودُ مُعَاوَضَةٍ، فَاعْتُبِرَ لَهَا ذَلِكَ كَالْبَيْعِ.
