مطالب أولي النهىal-Ruhaybani

(وَمَا أَخَذَهُ مُسْتَأْجِرٌ) جَمَعَ بَيْنَ عَقْدَيْ الْإِجَارَةُ وَالْمُسَاقَاةِ (مِنْ ثَمَرَةٍ) مِنْ الشَّجَرِ الْمُسَاقَى عَلَيْهِ، (أَوْ تَلِفَ) الثَّمَرُ تَحْتَ يَدِهِ؛ (فَمِنْ ضَمَانِهِ) - أَيْ الْمُسْتَأْجِرِ - لِفَسَادِ الْعَقْدِ، وَلَهُ أُجْرَةُ مِثْلِ عَمَلِهِ، وَهَذَا عَلَى الْأَوَّلِ، وَقَدْ عَلِمْتَ أَنَّ الْمُعْتَمَدَ خِلَافُهُ.
