وَلَوْ أَجَّرَا دَارَهُمَا لِرَجُلٍ، ثُمَّ أَقَالهُ أَحَدُهُمَا صَحَّ وَبَقِيَ الْعَقْدُ فِي نَصِيبِ الآخَرِ، ذَكَرَهُ الْقَاضِي

(وَلَوْ أَجَّرَا) - أَيْ اثْنَانِ - (دَارَهُمَا) الْمُشْتَرَكَةَ (لِرَجُلٍ وَاحِدٍ، ثُمَّ أَقَالَهُ أَحَدُهُمَا) - أَيْ أَحَدُ الْمُؤَجِّرَيْنِ - (صَحَّ) فِي نَصِيبِهِ، (وَبَقِيَ الْعَقْدُ) - أَيْ عَقْدُ الْإِجَارَةِ - (فِي نَصِيبِ) الشَّرِيكِ (الْآخَرِ، ذَكَرَهُ الْقَاضِي) أَبُو يَعْلَى.
