وَفِي وَقفٍ مِنْ نَاظِرِهِ أَوْ مُستَحِقهِ

مطالب أولي النهىal-Ruhaybani

(وَ) تَصِحُّ إجَارَةٌ (فِي وَقْفٍ مِنْ نَاظِرِهِ) ، لِأَنَّ لَهُ وِلَايَةَ الْإِيجَارِ؛ كَالْوَلِيِّ يُؤَجِّرُ عَقَارَ مُوَلِّيهِ (أَوْ) ؛ أَيْ: وَتَصِحُّ إجَارَةٌ مِنْ (مُسْتَحِقِّهِ) - أَيْ: الْوَقْفِ - لِأَنَّ مَنَافِعَهُ لَهُ، فَلَهُ إجَارَتُهَا كَالْمُسْتَأْجِرِ،
