وَيَتجِهُ: فِي حَيَوَانٍ كَشَهْرَينِ وَثَلَاثٍ.

مطالب أولي النهىal-Ruhaybani

(وَيَتَّجِهُ) أَنَّ الْوَكِيلَ الْمُطْلَقَ (فِي) إجَارَةِ (حَيَوَانٍ) لَهُ أَنْ يُؤَجِّرَهُ الْعُرْفَ؛ (كَشَهْرَيْنِ وَثَلَاثٍ) ، وَلَيْسَ لَهُ أَنْ يُؤَجِّرَهُ زِيَادَةً عَلَى ذَلِكَ؛ لِأَنَّ الْعُرْفَ لَا يَقْتَضِيهَا.

وَهُوَ مُتَّجِهٌ.
