(وَلَا يَسْتَنِيبُ) أَجِيرٌ خَاصٌّ فِيمَا اُسْتُؤْجِرَ لَهُ؛ لِوُقُوعِ الْعَقْدِ عَلَى عَيْنِهِ؛ كَمَنْ أَجَّرَ دَابَّةً مُعَيَّنَةً لِمَنْ يَرْكَبُهَا مُدَّةً، فَلَيْسَ لَهُ إبْدَالُهَا.
