مطالب أولي النهىal-Ruhaybani

(وَإِنْ امْتَنَعَ مَرِيضٌ مِنْ طِبٍّ مَعَ بَقَاءِ مَرَضٍ) فِي عَيْنِهِ؛ (اسْتَحَقَّ الطَّبِيبُ الْأُجْرَةَ بِمُضِيِّ الْمُدَّةِ) ؛ كَمَا لَوْ اسْتَأْجَرَهُ لِلْبِنَاءِ، فَلَمْ يَسْتَعْمِلْهُ فِيهِ، وَلِأَنَّ الْإِجَارَةَ عَقْدٌ لَازِمٌ، وَقَدْ بَذَلَ الْأَجِيرُ مَا عَلَيْهِ.
