مطالب أولي النهىal-Ruhaybani

(وَ) يَصِحُّ أَنْ يَسْتَأْجِرَ مَنْ يَقْلَعَ لَهُ ضِرْسَهُ أَوْ سِنَّهُ عِنْدَ الْحَاجَةِ إلَى قَلْعِهِ، (فَإِنْ أَخْطَأَ) الْأَجِيرُ، (فَقَلَعَ غَيْرَ مَا أُمِرَ بِهِ مِنْ ضِرْسٍ؛ ضَمِنَهُ) ؛ لِأَنَّهُ جِنَايَةٌ، وَلَا فَرْقَ فِي ضَمَانِهَا بَيْنَ الْعَمْدِ وَالْخَطَأِ إلَّا فِي الْقِصَاصِ وَعَدَمِهِ.
