فَإِنْ امْتَنَعَ أُجْبِرَ وَلِمُسْتَأْجِرٍ الْفَسْخُ وَلَا يُجْبَرُ عَلَى تَجْدِيدٍ

مطالب أولي النهىal-Ruhaybani

(فَإِنْ امْتَنَعَ) مُؤَجِّرٌ مِمَّا وَجَبَ عَلَيْهِ؛ (أُجْبِرَ) ؛ أَيْ: أَجْبَرَهُ حَاكِمٌ، (وَلِمُسْتَأْجِرٍ الْفَسْخُ) إزَالَةً لِمَا يَلْحَقُهُ مِنْ الضَّرَرِ بِتَرْكِهِ. (وَلَا يُجْبَرُ) الْمُؤَجِّرُ (عَلَى تَجْدِيدٍ) وَتَحْسِينٍ وَتَزْوِيقٍ؛ لِأَنَّ الِانْتِفَاعَ مُمْكِنٌ بِدُونِهِ.
