وَلَا يَلْزَمُ أَحَدُهُمَا تَزْويقٌ وَلَا تَجْصِيصٌ بِلَا شَرْطٍ

مطالب أولي النهىal-Ruhaybani

(وَلَا يَلْزَمُ أَحَدُهُمَا) - أَيْ الْمُؤَجِّرُ وَالْمُسْتَأْجِرُ. (تَزْوِيقٌ وَلَا تَجْصِيصٌ) وَنَحْوُهُمَا مِمَّا يُمْكِنُ الِانْتِفَاعُ بِدُونِهِ (بِلَا شَرْطٍ) ؛ لِأَنَّ الِانْتِفَاعَ لَا يَتَوَقَّفُ عَلَيْهِ.
