وَإِنْ شَرَدَتْ مُؤَخرَةٌ، أَوْ تَعَذَّرَ بَاقِي اسْتِيفَاءِ النَّفْعِ بِلَا فِعْلِ أَحَدِهِمَا فالأُجْرَةُ بِقَدْرِ مَا اسْتَوْفَى مِنْ عَمَلٍ وَزَمَنٍ

(وَإِنْ شَرَدَتْ) دَابَّةٌ (مُؤَجَّرَةٌ، أَوْ تَعَذَّرَ بَاقِي اسْتِيفَاءِ النَّفْعِ بِلَا فِعْلِ أَحَدِهِمَا) - أَيْ الْمُؤَجِّرُ وَالْمُسْتَأْجِرُ - فَعَلَى الْمُسْتَأْجِرِ مِنْ (الْأُجْرَةِ بِقَدْرِ مَا اسْتَوْفَى مِنْ عَمَلٍ وَزَمَنٍ) قَبْلَ ذَلِكَ؛ لِعُذْرِ كُلٍّ مِنْهُمَا.
