(وَيَتَّجِهُ) أَنَّهُ (لَا) يَجُوزُ لِلْأَجِيرِ حَبْسُ الْمَعْمُولِ (بِمُجَرَّدِ إعْسَارِ) الْمَالِكِ، بَلْ لَا بُدَّ مِنْ تَقَدُّمِ حُكْمِ الْحَاكِمِ بِإِعْسَارِهِ.
