مطالب أولي النهىal-Ruhaybani

(وَ) يَتَّجِهُ (أَنَّ مِثْلَهُ) أَيْ: مِثْلَ مَنْ زَرَعَ أَرْضًا مُعَارَةً فِي الْحُكْمِ (لَوْ رَجَعَ مُعِيرُ دَابَّةٍ) فِي أَثْنَاءِ الْمُدَّةِ مِنْ أَنَّ الْأُجْرَةَ تَلْزَمُ الْمُسْتَعِيرَ مِنْ حِينِ رُجُوعِ الْمَالِكِ حَيْثُ لَا ضَرَرَ (- وَلَوْ لَمْ يَعْلَمْ مُسْتَعِيرٌ) بِرُجُوعِهِ -
