مطالب أولي النهىal-Ruhaybani

(وَلَا) تُضْمَنُ (دَابَّةٌ) غُصِبَتْ، وَ (عَلَيْهَا مَالِكُهَا الْكَبِيرُ وَمَتَاعُهُ) ؛ لِأَنَّهَا فِي يَدِ مَالِكِهَا. قَالَهُ الْقَاضِي فِي " الْخِلَافِ الْكَبِيرِ " وَاقْتَصَرَ عَلَيْهِ فِي الْقَاعِدَةِ الثَّانِيَةِ وَالتِّسْعِينَ.
