لَا إنْ مَنَعَ وَلَو قِنًّا العَمَلَ مِنْ غَيرِ غَصْبٍ

(إنْ مَنَعَ) إنْسَانٌ آخَرَ - (وَلَوْ) كَانَ الْمَمْنُوعُ (قِنًّا) - (الْعَمَلَ مِنْ غَيْرِ غَصْبٍ) ، وَلَا حَبْسٍ؛ لِعَدَمِ تَلَفِهَا تَحْتَ يَدِهِ، وَلِأَنَّهُ فِي يَدِ نَفْسِهِ أَوْ سَيِّدِهِ، وَمَنَافِعُهُ تَلِفَتْ مَعَهُ؛ كَمَا لَا يُضْمَنُ هُوَ وَلَا ثِيَابُهُ إذَنْ.
