وَيَتَّجِهُ: وَيَلْزَمُهُ عَوْدُهُ حَيثُ لَا يَمْلِكُ قَلْعَهُ .

(وَيَتَّجِهُ وَيَلْزَمُهُ) - أَيْ الْقَابِضَ - (عَوْدُهُ) - أَيْ الْغِرَاسِ - إذَا قَلَعَهُ بِدُونِ إذْنِ مَالِكِ الْأَرْضِ (حَيْثُ) تَقَرَّرَ أَنَّهُ (لَا يَمْلِكُ) الْغَاصِبُ (قَلْعَهُ) ؛ كَمَا لَوْ هَدَمَ بِنَاءً، فَيَلْزَمُهُ عَوْدُهُ، وَهُوَ مُتَّجِهٌ.
