مطالب أولي النهىal-Ruhaybani

(وَ) إنْ كَانَ إقْرَارُ الْبَائِعِ؛ بِأَنَّ غَصْبَهُ مِنْهُ (فِي) مُدَّةِ (خِيَارٍ) ؛ فَإِنَّهُ (يَنْفَسِخُ الْبَيْعُ) ؛ لِأَنَّهُ يَمْلِكُ فَسْخَهُ، فَقُبِلَ إقْرَارُهُ بِمَا يَفْسَخُهُ، وَسَوَاءٌ كَانَ خِيَارُ مَجْلِسٍ أَوْ خِيَارُ شَرْطٍ لَهُمَا أَوْ لِلْبَائِعِ وَحْدَهُ، لَا لِلْمُشْتَرِي وَحْدَهُ،
