ولِنَفعٍ خَاصٍّ أَوْ بضَيِّقَةِ يَضْمَنُ

(لِنَفْعٍ خَاصٍّ) بِنَفْسِهِ، أَوْ كَانَ يَضُرُّ بِالْمَارَّةِ؛ كَأَنْ حَفَرَ الْبِئْرَ فِي الْقَارِعَةِ أَوْ بِطَرِيقٍ (ضَيِّقَةٍ) ؛ فَإِنَّهُ (يَضْمَنُ) مَا تَلِفَ بِهَا سَوَاءٌ فَعَلَهُ لِمَصْلَحَةٍ عَامَّةٍ أَوْ لَا، بِإِذْنِ الْإِمَامِ أَوْ لَا؛ لِمَا فِيهِ مِنْ الضَّرَرِ،
