وَلَوْ انْفَلَتَتْ دَابَّةٌ مِمَّنْ بِيَدِهِ، فَأَفْسَدَتْ فَلَا ضَمَانَ نَصًّا فَلَوْ اسْتَقْبَلَهَا إنْسَانٌ، فَرَدَّهَا؛ ضَمِنَ.

(وَلَوْ انْفَلَتَتْ دَابَّةٌ مِمَّنْ) هِيَ (بِيَدِهِ، فَأَفْسَدَتْ) شَيْئًا؛ (فَلَا ضَمَانَ) عَلَى أَحَدٍ؛ لِحَدِيثِ:«الْعَجْمَاءُ جَرْحُهَا جُبَارٌ» وَتَقَدَّمَ (فَلَوْ اسْتَقْبَلَهَا إنْسَانٌ، فَرَدَّهَا؛ ضَمِنَ) .
