(وَإِنْ عَلِمَ) مَالِكَهُ وَأَنَّهُ مَاتَ، (وَلَمْ يُعَقِّبْ) ذُرِّيَّةً وَلَا وَارِثًا؛ لَمْ يَمْلِكْ أَيْضًا بِالْإِحْيَاءِ (وَأَقْطَعَهُ الْإِمَامُ) لِمَنْ شَاءَ؛ لِأَنَّهُ فَيْءٌ.
