وَإنْ عُلِمَ مِلكُهُ لِمُعَيَّنٍ غَيرِ مَعصُومٍ فَإِنْ أَحْيَاهُ بِدَارِ حَربٍ وَانْدَرَسَ كَان كَمَوَاتٍ أَصلِيٍّ

مطالب أولي النهىal-Ruhaybani

(وَإِنْ عُلِمَ مِلْكُهُ) - أَيْ: الدَّارِسِ الْخَرَابِ - (لِمُعَيَّنٍ غَيْرِ مَعْصُومٍ) بِأَنْ كَانَ لِكَافِرٍ لَا ذِمَّةَ لَهُ وَلَا أَمَانَ، (فَإِنْ) كَانَ (أَحْيَاهُ بِدَارِ حَرْبٍ وَانْدَرَسَ كَانَ) ذَلِكَ (كَمَوَاتٍ أَصْلِيٍّ) ؛ أَيْ: فَيَمْلِكُهُ مَنْ يُحْيِيهِ، لِأَنَّ مِلْكَ مَنْ لَا عِصْمَةَ لَهُ كَعَدَمِهِ،
