وَكُلُّ وَاحِد نَقْبًا فَلِكُل وَاحِدٍ دِينَارًا كَمَنْ دَخَلَ هَذَا النقبَ فَلَهُ دِينَار، فَدَخَلَهُ جَمَاعَةٌ؛ استَحَق كُل وَاحِد دِينَارًا

مطالب أولي النهىal-Ruhaybani

(وَ) إنْ نَقَبَ (كُلُّ وَاحِدٍ نَقْبًا فَكُلُّ وَاحِدٍ دِينَارًا) كَمَا لَوْ قَالَ: (مَنْ دَخَلَ هَذَا النَّقْبَ فَلَهُ دِينَارٌ، فَدَخَلَهُ جَمَاعَةٌ؛ اسْتَحَقَّ كُلُّ وَاحِدٍ) مِنْهُمْ (دِينَارًا) ؛ لِأَنَّ كُلَّ وَاحِدٍ مِنْ الدَّاخِلِينَ دَخَلَ دُخُولًا كَامِلًا كَدُخُولِ الْمُنْفَرِدِ، فَاسْتَحَقَّ الْعِوَضَ كَامِلًا.
