وَإنْ اختَلَفَا في أَصْلِ جُعْلٍ فَقَوْلُ مَنْ يَنْفِيهِ

مطالب أولي النهىal-Ruhaybani

(وَإِنْ اخْتَلَفَا فِي أَصْلَ الْجَعَالَةِ) - أَيْ: التَّسْمِيَةِ - بِأَنْ أَنْكَرَهُ أَحَدُهُمَا؛ فَالْقَوْلُ (قَوْلُ مَنْ يَنْفِيهِ) مِنْهُمَا؛ لِأَنَّ الْأَصْلَ عَدَمُهُ.

وَإِنْ اخْتَلَفَا
