(وَمَنْ ادَّعَاهُ) - أَيْ: الْآبِقَ - أَنَّهُ مِلْكُهُ بِلَا بَيِّنَةٍ، (فَصَدَّقَهُ الْآبِقُ الْمُكَلَّفُ؛ أَخَذَهُ) ؛ لِأَنَّهُ إذَا اُسْتُحِقَّ أَخْذُهُ بِوَصْفِهِ إيَّاهُ فَتَصْدِيقُهُ عَلَى أَنَّهُ مِلْكُهُ أَوْلَى.
