(فَإِنْ) اُلْتُقِطَ صَغِيرٌ، وَ (جُهِلَ رِقُّهُ) وَحُرِّيَّتُهُ؛ فَهُوَ (حُرٌّ لَقِيطٌ) ، قَالَ الْمُوَفَّقُ: لِأَنَّ اللَّقِيطَ مَحْكُومٌ عَلَى حُرِّيَّتِهِ؛ لِأَنَّهُ الْأَصْلُ عَلَى مَا يَأْتِي فِي اللَّقِيطِ.
