(وَ) النَّمَاءُ (الْمُنْفَصِلُ بَعْدَ حَوْلِ تَعْرِيفِهَا لِوَاجِدِهَا) ؛ لِأَنَّهُ مَلَكَ اللُّقَطَةَ بِانْفِصَالِ الْحَوْلِ، فَنَمَاؤُهَا إذَنْ نَمَاءُ مِلْكِهِ، فَهُوَ لَهُ، لِيَكُونَ الْخَرَاجُ بِالضَّمَانِ.

وَأَمَّا النَّمَاءُ الْمُنْفَصِلُ فِي حَوْلِ التَّعْرِيفِ فَيُرَدُّ مَعَهَا؛ لِأَنَّهُ تَابِعٌ لَهَا.
