وَلَوْ أَدْرَكَهَا رَبُّهَا بَعْدَ الْحَوْلِ مَبِيعَةً، أَوْ مَوْهُوبَةً فَلَيسَ لَهُ إلَّا الْبَدَلُ

مطالب أولي النهىal-Ruhaybani

(وَلَوْ أَدْرَكَهَا) - أَيْ: اللُّقَطَةَ - (رَبُّهَا بَعْدَ الْحَوْلِ) وَالتَّعْرِيفِ (مَبِيعَةً، أَوْ) أَدْرَكَهَا (مَوْهُوبَةً) بِيَدِ مَنْ انْتَقَلَتْ إلَيْهِ، أَوْ أَدْرَكَهَا مَوْقُوفَةً؛ (فَلَيْسَ لَهُ) - أَيْ: لِرَبِّهَا - (إلَّا الْبَدَلُ) ؛ لِأَنَّ تَصَرُّفَ الْمُلْتَقِطِ وَقَعَ صَحِيحًا؛ لِكَوْنِهَا صَارَتْ فِي مِلْكِهِ.
