مطالب أولي النهىal-Ruhaybani

(إنَّمَا يَلْزَمُ الْعَمَلُ بِشَرْطٍ مُسْتَحَبٍّ) .

قَالَ: وَعَلَى النَّاظِرِ بَيَانُ الْمَصْلَحَةِ أَيْ: التَّثَبُّتُ وَالتَّحَرِّي فِيهَا؛ بِدَلِيلِ قَوْلِهِ، فَيَعْمَلُ بِمَا ظَهَرَ لَهُ أَنَّهُ مَصْلَحَةٌ، وَمَعَ الِاشْتِبَاهَ إنْ كَانَ النَّاظِرُ عَالِمًا عَادِلًا سَاغَ لَهُ اجْتِهَادُهُ.
