(وَنَبِيذٌ) فِي الْحُكْمِ (كَخَمْرٍ) مِنْ أَنَّهُ يَطْهُرُ هُوَ وَإِنَاؤُهُ إذَا انْقَلَبَ، خَلًّا (خِلَافًا لِلْقَاضِي) أَبِي يَعْلَى، حَيْثُ جَزَمَ فِي " التَّعْلِيقِ " بِعَدَمِ طَهَارَتِهِ بِانْقِلَابِهِ خَلًّا، (مُحْتَجًّا بِأَنَّ فِيهِ) مَا قَدْ (تَنَجَّسَ) فَيَتَنَجَّسُ مَا أَصَابَهُ، وَلَوْ صَارَ خَلًّا.
