مطالب أولي النهىal-Ruhaybani

(فَإِنْ لَمْ تُقْلَعْ) الشَّجَرَةُ؛ بِأَنْ أَعْرَضَ عَنْهَا غَارِسُهَا وَأَثْمَرَتْ (فَثَمَرُهَا لِمَسَاكِينِهِ) أَيْ: الْمَسْجِدِ؛ قَالَ الْحَارِثِيُّ: وَهُوَ الْمَذْهَبُ. قَالَ: وَالْأَقْرَبُ حِلُّهُ لِغَيْرِهِمْ مِنْ الْمَسَاكِينِ، أَيْضًا (وَقَالَ أَحْمَدُ: لَا أُحِبُّ الْأَكْلَ مِنْهَا) لِأَنَّهَا غُرِسَتْ بِغَيْرِ حَقٍّ
