(وَلَا يُعْتَبَرُ فِيهَا) - أَيْ: الْوَصِيَّةِ - (الْقُرْبَةُ؛ لِصِحَّتِهَا لِنَحْوِ حَرْبِيٍّ) بِدَارِ حَرْبٍ. نَصَّ عَلَيْهِ أَحْمَدُ كَمَا تَصِحُّ هِبَتُهُ، فَصَحَّتْ الْوَصِيَّةُ لَهُ كَالذِّمِّيِّ. (وَ) تَصِحُّ (لِمُرْتَدٍّ) اخْتَارَهُ أَبُو الْخَطَّابِ، وَيَأْتِي.
