قال: "ومن وطيء جاريته ثم زوجها جاز النكاح" لأنها ليست بفراش لمولاها فإنها لو جاءت بولد لا يثبت نسبه من غير دعوة إلا أن عليه أن يستبرئها صيانة لمائه
