وَلَو زَوجهَا فبلغها الْخَبَر فَسَكَتَتْ فَهُوَ على مَا ذكرنَا

"ولو زوجها فبلغها الخبر فسكتت فهو على ما ذكرنا" لأن وجه الدلالة في السكوت لا يختلف ثم المخبر إن كان فضوليا يشترط فيه العدد أو العدالة عند أبي حنيفة رحمه الله خلافا لهما ولو كان رسولا لا يشترط إجماعا وله نظائر.
