"وأقل المهر عشرة دراهم" وقال الشافعي رحمه الله ما يجوز أن يكون ثمنا في البيع يجوز أن يكون مهرا لها لأنه حقها فيكون التقدير إليها ولنا قوله عليه الصلاة والسلام "ولا مهر أقل من عشرة" ولأنه حق الشرع وجوبا إظهارا لشرف المحل فيتقدر بماله خطر وهو العشرة استدلالا بنصاب السرقة.
