"وإذا تزوج العبد بإذن مولاه فالمهر دين في رقبته يباع فيه" لأن هذا دين وجب في رقبة العبد لوجود سببه من أهله وقد ظهر في حق المولى لصدور الإذن من جهته فيتعلق برقبته دفعا للمضرة عن أصحاب الديون كما في دين التجارة
